Preamble

The MSC Startup Hub 2026 provides the world's leading forum for security policy - the “Munich Security Conference” - with a dedicated platform for technology and innovation. MSC Startup Hub takes place at the Chamber of Industry and Commerce Munich and Upper Bavaria bringing together leading decision and policy makers, industry experts, academia and cutting-edge startups with high-profile speakers and guests to address the importance of deep tech and transatlantic cooperation for global independences (hereinafter the "Event").

1. General Provisions / Scope of Application

1.1 These General Terms and Conditions ("GTC") apply to the participation in the Event hosted by the Organizer. Deviating terms and conditions of the participant shall not apply, unless the Organizer has expressly agreed to them in individual cases.

1.2 The Organizer reserves the right to make changes and additions to these GTCs. Amendments and supplements shall become effective upon publication on the Event website MSC Startup Hub Website (the "Website").

1.3 Legally relevant declarations and notifications by the participant (e.g. setting of deadlines, notification of defects, withdrawal or reduction) must be made in writing or text form (e.g. by letter or e-mail). Statutory formal requirements and the right to request further proof, in particular in case of doubt about the legitimacy of the declarant, remain unaffected.

1.4 References to statutory provisions are made for clarification purposes only. Even without such clarification, the statutory provisions shall therefore apply unless they are explicitly amended or expressly excluded by these GTC.

2. Registration

2.1 The registration for the participation in the Event is exclusively possible via the following link.

2.2 Registration is valid only once all mandatory fields (each marked with "*") are completed and the participant has confirmed acceptance of these GTC and the Privacy Policy (Section 9) via opt-in.

2.3 The participant warrants that all data provided during registration is true and complete. If registration is made on behalf of another person, it must be ensured that the participating person has been informed of and accepts these GTC. By completing and submitting the registration form, it is declared and guaranteed that the participant has been made aware of and has accepted these GTC.

2.4 Upon successful registration, the ticket will be sent to the email address provided.

2.5 No tickets will be sent via post or fax. The participant is responsible for safekeeping and presentation of the ticket at the Event.

3. Event Structure and Content

3.1 The content, format, schedule and design of the Event as well as speaker selection are at the sole discretion of the Organizer.

3.2 There is no entitlement to specific speakers or a specific schedule. The Organizer may reasonably adjust the details of the event at any time. The Organizer will - as far as possible - provide an equivalent substitute.

3.3 Presentations at the Event will be held in German or English. There is no entitlement to interpretation/translation services.

3.4 All event-related content, in particular presentations and materials, is protected by copyright. Use is restricted to the personal purposes of the participant. Passing on content to third parties is prohibited, regardless of the purpose.

3.5 Any use or exploitation of the copyrighted content beyond private use, including in particular through duplication, distribution, exhibition, reproduction in corporeal form (right of public reproduction, i.e. lecture, performance and presentation, making available to the public, broadcasting, reproduction by means of image or sound carriers, reproduction of radio broadcasts and of making available to the public) as well as recording, digitization, storage - regardless of the form and on which carrier medium and in which technical configuration - is strictly prohibited.

3.6 The Organizer assumes no liability for any inaccuracies in the content of the presentations or materials.

4. Special Provisions for the On-Site Event

4.1 Participants must present a valid ticket at the admission control without being asked. As the right to access is granted to the person named as participant, the participant may also be asked to identify themselves with a valid official identification document/ government-issued ID. Upon admission, participants will receive a non-transferable badge (e.g. an Event badge), which they must carry with them at all times during the Event, specifically with respect to re-admittance after leaving Event premises.

4.2 Participants are obliged to comply with all applicable public health and safety regulations. The Organizer may limit access to the venue or specific areas thereof or require hygiene measures, for example, but not exclusively, to wear a mouth-nose covering, FFP-2 mask or medical face mask in the entire event area, to ensure compliance.

4.3 The Organizer reserves the right to deny admission to persons violating house rules, behaving aggressively or under the influence of intoxicants. Weapons or dangerous objects are prohibited. The Organizer exercises householder’s rights. Organizer instructions shall be followed. Violations may lead to exclusion from the Event. Further claims of the Organizer against the participant remain unaffected.

§ 4a Photos and Video Recordings

During the Event, photographs and video recordings may be taken for the purpose of documenting and promoting the Event. These recordings may be published on the Organizer’s websites, social media channels, and in press releases.

In connection with the registration and/or by attending the Event, Participant expressly agree to the publication of such images, unless they object on site or in advance. The legal basis is Art. 6 para. 1 sentence 1 lit. f) GDPR.

Participants may object at any time by contacting the Organizer. Reference is made to Section 9 Data Protection and the Privacy Policy.

5. Change to Digital Event, Postponement, Cancellation due to Force Majeure

5.1 The Organizer reserves the right to hold the Event completely online ("Digital Event") in case of justified interest. In the case of a Digital Event, the Organizer will ensure - to the extent possible - that both the content of the Event and the possibility for participants to network with each other correspond as closely as possible to the standard of a face-to-face Event. For this purpose, the Organizer uses suitable technical means to fulfil the information and networking purpose of the respective Event. In such cases, the Organizer will inform the participants promptly.

5.2 If the Event is postponed, the tickets shall remain valid for the new date. If a participant is unavailable on the new date, their registration may be transferred to another person.

5.3 Force majeure such as war, civil war, terrorism, riots, civil commotion, embargoes, natural disasters, fire, epidemics, pandemics, legislative activities, court decisions, official orders, or other unforeseeable circumstances for which the Organizer is not responsible and which prohibit the Organizer from executing the Event, such as without being limited to labour disputes or lawful lockouts, operational or transport disruptions, raw material procurement difficulties, entitle the Organizer to cancel the Event. The Organizer is not liable for damages and disadvantages resulting from the cancellation of the Event for the participant.

6. General Obligation to Lawful Behaviour

Participants must ensure that their actions in connection with the Event do not violate legal regulations and/or the rights of third parties. In particular, Participants are obligated to check the legal admissibility of any actions/inactions themselves and to behave in a legally compliant manner. Clause 8.2 regarding indemnification obligation towards Organizer in case of violation applies.

7. Liability of the Organizer

The Organizer shall only be liable (i) for damages caused intentionally or through gross negligence, (ii) for the culpable breach of essential contractual obligations by the Organizer, i.e. such obligations, the fulfilment of which enables the proper execution of the contract in the first place and on the compliance of which the participant relies and may rely on, (iii) for damages caused as a result of fraudulent misrepresentation, (iv) for damages resulting from injury to life, limb or health caused by a negligent breach of duty by the Organizer.

In all other cases, liability is excluded.

8. Liability of the Participants

8.1 Participants shall be liable in accordance with statutory regulations for all damages for which they are responsible in connection with the Event.

8.2 Participants shall indemnify the Organizer against any third-party claims in connection with the Event, provided that and to the extent the participant is responsible for such claims. This includes official fines and administrative penalties (e.g. for disturbing the peace, blocking escape routes, disregarding smoking bans) imposed on the Organizer in connection with the Event, to the extent such measures are attributable to the participant’s conduct.

In this respect, Participants undertake to indemnify the Organizer against any liability towards third parties, to support the Organizer in the legal defence, and to bear the costs of the appropriate legal defence, insofar as the Organizer is not guilty of contributory negligence. In this case, the exemption is to be reduced by the contributory negligence.

10. Publication of the List of Participants

In order to enable participants to "network" and communicate with other participants during the Event, the data provided by the participant (first name, last name, title and company) will be published as part of the list of participants provided for the Event subject to the participant having agreed to this publication during the registration process (Section 2.2) (opt-in). The list of participants is not publicly viewable, it is only available digitally to other participants of the Event via a networking platform. The legitimate interest of the Organizer in processing this data lies in the purpose described above (Art. 6 para. 1 p. 1 lit. f) DS-GVO). Notwithstanding their opt-in during the registration process, the participants have the right to withdraw their consent at any time with future effect by e-mail to msc-startup-hub@unternehmertum.de or by letter or e-mail to the data protection officer of the Organizer:

11. Final Provisions

11.1 These GTC and the entire legal relationship between the parties shall be governed by German law. This choice of law shall only apply to consumers to the extent that it does not deprive them of the protection afforded by mandatory consumer protection laws of their country of habitual residence, in accordance with Article 6(2) of Regulation (EC) No 593/2008 (Rome I).

11.2 To the extent permitted by law, Munich shall be the place of performance and exclusive - place of jurisdiction, including international jurisdiction.

11.3 Should any part of these GTC be void or voidable, the validity of the remaining provisions shall not be affected thereby. The invalid provision shall be replaced by a valid provision that comes closest to the intended purpose. The same shall apply in case of any gaps.
